Police interrogation advice

Always invoke your right to remain silent until you’ve had the chance to speak privately and calmly with a lawyer. Together, discuss your situation, defense strategy, and expected course of the procedure. You can always give a statement later. Never admit to acts you didn’t commit - it can severely damage your case.

1. You are not obliged to answer questions, as every suspect has the right to remain silent – even if you are innocent, you may unintentionally incriminate yourself during questioning. 2. If you have your own lawyer, immediately ask to contact them after being detained; remember, you do not have to agree to a duty lawyer (so-called “piketadvocaat”). 3. Never give the police permission to enter your home unless they show a warrant, identify themselves, and clearly state the purpose of entry. 4. Do not sign any statements or other documents without first consulting your lawyer. 5. Do not relinquish any of your belongings (property) without first speaking to your lawyer. 6. Stick only to facts that you have personally observed or experienced. 7. Do not draw conclusions or agree with conclusions presented by the police or prosecution.

8. If you have any doubts, ask to speak to your lawyer during questioning; if this request is refused, use your right to remain silent. 9. It is best not to sign any statements. If you do decide to sign, only do so after reading the document carefully and making sure it contains exactly what you wanted to say – and nothing more. 10. Remember that once you have signed a (self-incriminating) statement, it will almost always be accepted as true by the court. Withdrawing such a statement later is very difficult. 11. Do not trust promises from the police that you will get home faster if you make a statement – the police usually do not control this, and such assurances are rarely true.
